In a recent ruling, a Dutch court has granted permission for Alexey Pertsev to await trial from his home. For your information, Pertsev is the Russian developer associated with the Tornado Cash privacy protocol. The decision came from a court in Hertogenbosch, following Pertsev’s arrest in August. His arrest fell under the directive of the Dutch financial crime authority, FIOD. Pertsev’s lawyer, Keith Cheng, expressed joy at the prospect of his client’s release. Later on, he stated that Pertsev can now “work even harder and better on his defense.”
Pertsev will be required to wear an ankle bracelet for electronic monitoring purposes. He is set to be released next Wednesday. He will not, however, be required to pay any financial security. The release has been scheduled to allow time to install the necessary monitoring devices at Pertsev’s home.

The arrest came just before the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC) imposed sanctions on Tornado Cash. According to OFAC, Tornado Cash had been utilized to raise funds for the North Korean regime. The Dutch public prosecutor had initially argued that Pertsev posed a flight risk and could potentially conceal evidence if released. Nevertheless, until recently, only general accusations have been made against him.

This week, the public prosecutor presented more specific charges against Pertsev. According to these charges, Pertsev had repeatedly laundered over 500,000 Ethereum (ETH), which he should have reasonably suspected originated from criminal activities. Pertsev has denied all of these charges.
